Marriage Fraud and K-1 Visas

There are potentially severe consequences for obtaining a K-1 fiancee visa through marriage fraud.

    September 22, 2011 /Dating - Singles PR News/ -- The story of Americans bringing foreign nationals into the country for marriage is increasingly common. More people, however, are participating in elaborate marriage fraud schemes to circumvent immigration laws and to make a profit.

Those seeking to immigrate to the United States to marry an American citizen must apply for a K-1 visa. This type of visa requires a foreign national to marry his or her fiancee within 90 days of entry. Once married, a person can seek lawful permanent resident status after two years of marriage. Immigrating through marriage is generally much faster than waiting for other categories of visas, which is why marriage visas are constantly abused.

The United States Attorney in Sacramento recently announced that 14 people would be charged in a marriage fraud scheme involving foreign nationals from Russia, Ukraine, and other Eastern European countries. According to court documents, six foreign nationals attempted to obtain fiance visas and several U.S. citizens agreed to marry them in return for payments as high as $5,000. Authorities also discovered fraudulent wedding photos and believe that those involved rehearsed answers to deceive immigration agents.

The USCIS believes that marriage fraud is very serious, and has a number of ways of rooting out sham marriages. It is estimated that 30 percent of all K-visa applications are fraudulent. Because of this, obtaining a proper visa has become more arduous and detailed. Applicants must complete more paperwork and provide additional proof of financial support, eligibility to marry, and of course, proof of a legitimate relationship. Mistakes may result in longer processing delays or rejection.
